These terms and conditions apply to the website www.urbandesigncare.pt and its online store, provided by Urban Nail Design Care Unipessoal, Lda., corporate entity number 510 923 976, headquartered at Avenida Av.ª Francisco Sá Carneiro, No. 54, 4520-164 Santa Maria da Feira, hereinafter also referred to as URBAN, and are intended to regulate their use and proper functioning, as well as the relationships, contacts, and transactions established between URBAN and the user/client.

Please note that, if necessary and without prior notice, URBAN may unilaterally change both the content and services of this page as well as the terms and conditions of use, with the conditions in force on the day the order is placed by the User applying to each order.
Browsing and purchasing through the website and/or digital applications implies acceptance of the information and practices described in this document and the Exchanges and Returns policy. Online sales are valid and applicable to the territories of Mainland Portugal, the Azores and Madeira Archipelagos, and countries belonging to the European Union.

URBAN owns this website and online store. Unless expressly stated otherwise, Urban and/or its partners/suppliers own all its content (own brand logos, design, photography, and presentations), which are protected by industrial and intellectual property laws. Therefore, no content may be modified, reproduced, published, or distributed without prior authorization from URBAN.
Use of the Website and Online Store
URBAN strives to ensure uninterrupted site availability and error-free communications. However, it acknowledges that access to and use of the website and platform may experience interruptions and that the information may contain bugs, errors, technical failures, issues, or other limitations, and access may even be impossible at certain times.
By accessing the website www.urbandesigncare.pt and placing an order through the online store, the user confirms having read and accepted, without any reservations, these terms and conditions and any necessary updates.
Online Store and General Terms of Sale
The terms of sale aim to define the general conditions of sale between Urban Design Care and the User from the moment of purchase until the delivery of the products related to that purchase.
The online store is intended solely for professionals in the beauty and cosmetics field, namely makeup, manicure, pedicure, skin cleansing, waxing, and similar services, so by making a purchase in this domain, the user confirms and guarantees that the goods will be used exclusively for professional purposes, excluding any domestic use or end consumer use.
Order shipment will be made to Mainland Portugal, Islands (Azores and Madeira), and within the territory of the European Union.
The seller reserves the right not to process orders received from users identified as end consumers or those that do not comply with the general terms and conditions of sale of the URBAN store.
URBAN reserves the right to modify any and all information and commercial offers in the URBAN store, including but not limited to conditions, products, prices, services, and promotions.
Order
The user may place their order online through this site, by phone contact, and/or in person, indicating the item references or selecting the desired items through the existing categories.
Purchased items are subject to stock availability limits. Availability information is provided at the time of ordering. In the event that an item becomes unavailable between order confirmation and final validation, Urban Design Care commits to informing the User as soon as possible by email or phone and to refund any amount paid for that item.
Placing an order in the URBAN online store is very easy:
– Browse the online store and find the products you wish to purchase;
– Add products to your shopping cart;
– When you consider your shopping complete, check your cart;
– Calculate the shipping costs and complete your purchases;
– Then fill out the form with your personal data;
– Select the payment method;
– Review your order;
– Proceed with the payment to complete your order; and
– You will receive an order confirmation via email.
Whenever making a purchase, the User must provide all the personal data necessary for registration and shipment of their purchase, filling in all the mandatory fields of the form.
To make your purchase, the User must confirm the general sales conditions and the price of the items and express acceptance; by submitting the order form, you accept all conditions existing in this Online Store. For purchases made through our online store, the final validation of the purchase is done by the user on our site at the time of checkout. Once the purchase is completed, the user will receive an automatic email confirming the transaction.
In case of non-confirmation of payment, incomplete or incorrect orders, unavailable products, or breach of any sales terms and conditions, URBAN reserves the right not to accept the user's order or to cancel it fully or partially, even after automatic confirmation, with the user being notified by email that the sales contract was not completed and that the seller did not proceed with the sale, specifying the reasons.
URBAN reserves the right not to accept your order or to cancel it even after automatic confirmation, under the following conditions, without liability for any damages or costs:
– The product is no longer available in stock;
– The information on the invoice is incorrect or unverifiable;
– The order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
– If the payment transfer for the order is not received within 10 days after acceptance of the order;
– When it is not possible to deliver the order to the address provided by the consumer;
– If it is considered that the buyer did not have the capacity to perform that act;
– If an error is found in the presentation of the product(s) price;
– If it is presumed that the order comes from a consumer.
Under the provisions of Decree-Law No. 7/2004 of January 7, regarding electronic commerce, URBAN reserves the right to unilaterally cancel the order whenever there is a programming error, malfunction of URBAN's computers, or if the contractual proposal arrives distorted at its destination and the error affects an essential element of the contract.
Payment Methods
The available payment methods are those presented on this site; no other payment methods besides those mentioned are accepted.
You can pay for your products via Bank Transfer, Multibanco (service provision mode), MBWAY, and Paypal, with all necessary instructions and information provided for these payment methods at the time of selection.
Order processing will begin after payment is received.
Please do not attempt to pay by any means other than those specified. If you do, we cannot be held responsible for loss of payment or any other damages that may result.
Prices and Shipping Costs
The product prices displayed on the website are quoted in euros (€) and include Value Added Tax (VAT).
Shipping fees are applied per order. The exact shipping fee will depend on the location, weight, and the selected shipping method.
The total price specified at the end of the ordering process includes taxes and shipping costs. Prices are quoted at the time of order confirmation.
Please always pay the amount specified in the order confirmation and make individual payments per order.
The prices listed in URBAN's online store are subject to change, and URBAN reserves the right to do so without prior notice. Although the entire store is managed with great care, price information may contain errors. URBAN does not commit to the offer and reserves the right to cancel the order if such an error occurs.
Quality, guarantee and after-sales service
URBAN sells only high-quality products intended for professional use. The online store is exclusively for professionals in the beauty and cosmetics field, namely makeup, manicure, pedicure, skin cleansing, waxing, and similar services. Therefore, by making a purchase in this domain, the user confirms and guarantees that the goods will be used exclusively for professional purposes, excluding any domestic use or final consumer use.
As these transactions are carried out within the scope of professional relationships, the legal regime for the sale of consumer goods will generally not apply. Without prejudice to the above, if the consumer goods sales regime is applicable to the transaction, these products will be covered by a 2 (two) year conformity guarantee when delivered by 31.12.2021; or a 3 (three) year guarantee when delivered after 01.01.2022. It is noted that, when the 3 (three) year guarantee applies, any non-conformity that appears within two years from the date of delivery is presumed to have existed at the time of delivery to the buyer, unless this is incompatible with the nature of the goods or the characteristics of the non-conformity. If the non-conformity appears in the third year of the guarantee, the buyer must prove that the non-conformity existed at the time of delivery.
There is no non-conformity when, at the time of contract conclusion, the consumer was unequivocally informed that a particular characteristic of the good deviated from the objective legal conformity requirements and accepted this deviation separately, expressly, and unequivocally.
Except for this exception and in any other case, all products sold on www.urbandesigncare.pt are covered by the legally applicable warranties for the specific case.
If the purchased product shows a defect or malfunction, the user must report the situation within a maximum of 30 (thirty) days after becoming aware of the defect and within six months after delivery, to URBAN's Customer Service, providing the order number and a description of the defect or malfunction:

The costs of returning or collecting items within the warranty period will be borne by URBAN.
After receiving the item at URBAN's facilities, it will be inspected.
The diagnosis of non-conformity verification will be carried out within an expected period of 30 (thirty) days, except when a longer period is necessary for a valid and justified reason.
In the proven case of any non-conformity, the item will be repaired or replaced if repair is not possible. In this case, URBAN will send the repaired or new item to the user's address at no additional cost.
If the item is no longer available and is not repairable, URBAN will refund the Customer the amount paid, as well as the shipping and return costs.
If the verification carried out by URBAN reveals signs of misuse, and/or any problem that may have caused the defect or malfunction of the item (e.g., drop), the Customer will be contacted to indicate whether they wish to proceed with the repair of the item, if it is repairable, bearing the costs thereof.
The products for sale in the URBAN store may not exactly match the actual product in terms of image and colors, due to the browser and/or monitor used.
Shipping and Delivery
Products ordered from the URBAN online store will be shipped and delivered on business days, Monday to Friday. We can only guarantee proper delivery if the shipping address is correctly provided by the buyer. To receive the order, it is necessary to ensure that someone is at the address. This service does not include scheduling or appointment, so delivery will be made without prior notice from the carrier.
An order is considered delivered upon confirmation by the carrier.
At the time of delivery, the buyer must inspect the packaging and the products sent to check for any damage. If the products are found to be damaged, the buyer must reject the order and return it to the seller’s facilities. If URBAN confirms that the order or products were damaged, it will resend the order or refund the amounts paid for the order and shipping upon receipt and completion of the damaged order process.
Once the order is registered, payment confirmed, and all items in your order are available, the seller commits to having the products available at the physical store chosen by the User within 2 business days, or to proceed with shipping observing the following delivery times:
– Mainland Portugal – Within a maximum of 5 business days.
– In the Madeira and Azores Archipelagos and in Spain, between 5 to 10 business days.
– In the European Union (except Portugal and Spain), approximately 5 to 15 business days.
The seller shall not be liable for any delay or failure to perform any obligation due to force majeure, that is, an event, act, or omission beyond their reasonable control.
Cancellation or withdrawal
Goods produced according to user specifications or clearly personalized do not allow order cancellation.
If the products are not made according to user specifications or clearly personalized, and as a remote purchaser of our products in our online store, the User has the right to cancel the contract within a maximum period of 14 (fourteen) days after receiving the products, without needing to state any reason.
The deadline for exercising the right of withdrawal expires 14 days from the day after the day on which you or a third party indicated by you, other than the carrier, takes physical possession of the goods, or, in the case of an order with multiple goods, the day after the day on which you or a third party indicated by you, other than the carrier, takes physical possession of the last item.
To exercise your right of withdrawal, you must inform us – Urban Nail Design Care, Unip. Lda, Av. Francisco Sá Carneiro, nº 54. 4520-164 Santa Maria da Feira, tel: 913200951 (call to national mobile network), email: info@urbandesigncare.pt, of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or email). You may use the withdrawal form template available at: https://www.urbandesigncare.pt/devolucoes/, but this is not mandatory.
To respect the withdrawal period, it is sufficient that your communication regarding the exercise of the right of withdrawal is sent before the withdrawal period expires.
In case of exercising the right of withdrawal from the contract, all payments made by the Customer will be refunded, including delivery costs (except for additional costs resulting from the choice of a delivery method other than the least expensive standard delivery offered by URBAN), without undue delay and in any case no later than 14 (fourteen) days from the date URBAN is informed of the User's decision to withdraw from the contract.
We make these refunds using the same payment method you used in the initial transaction, unless expressly agreed otherwise by you; in any case, you will not incur any costs as a result of such refund.
We may withhold the refund until we have received the returned goods, or until you provide proof of sending the goods, whichever occurs first. You must return or deliver the goods without undue delay and no later than 14 days from the day you inform us of the withdrawal from the contract. The deadline is considered met if you return the goods before the end of the 14-day period.
The user must bear the direct costs of returning the goods, according to the amount charged by postal services, and is only responsible for any depreciation of the goods resulting from handling that exceeds what is necessary to verify the nature, characteristics, and functioning of the goods.
If the customer has made the payment by bank reference, it is necessary to provide their bank details to our Customer Support at the start of the return process. This information is required so that we can proceed with the refund to their account.
The exercise of the right of withdrawal depends on the verification of the following conditions:
- the purchased items are returned within the legal period and in proper condition;
- the products have not been used or washed;
- products maintain their original characteristics and are complete;
- products that have not been tampered with or modified;
- the buyer bears all return shipping costs.
Orders for personalized products cannot be canceled before shipment, as the customization process is already underway, starting immediately after receipt of the order and payment. This type of item can only be returned if it has defects or discrepancies regarding the ordered products.
Liability
All Products sold on the site www.urbandesigncare.pt are in compliance with Portuguese law.
URBAN is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions, or disconnections of the operating system that may temporarily prevent access, navigation, or service provision to the User.
URBAN declines any responsibility for any delay or inability to process the order, including at the time of delivery, resulting from errors or insufficient data provided by the User. Likewise, URBAN cannot be held responsible if failure to fulfill its obligations is due to an unforeseeable or insurmountable third-party event or a force majeure case.
URBAN cannot be held responsible for damages suffered by third parties resulting from the use of any of our products or as a consequence of misuse of our products.
Validity of promotions and offers
The offers on the site are only valid at the time they are displayed on the site, unless otherwise stated on the site. URBAN is not bound by any offer if there are spelling errors, price mistakes, or other inaccuracies in the information on the site. The seller reserves the right to cancel any purchase and sale made under such errors.
Applicable Law and Jurisdiction
Portuguese law applies to the presented terms of sale.
In the absence of resolution by agreement of the parties, any dispute arising from these General Terms of Sale will be submitted to the competent Portuguese court.
